FLORIDA NO BROKERAGE RELATIONSHIP DISCLOSURE

The following notice NO BROKERAGE RELATIONSHIP DISCLOSURE is being made to all visitors to this website. The default brokerage relationship for RESIDENTIAL customers for Florida real estate services is that of a Transaction Broker, wherein the broker represents the TRANSACTION. It limits the duties owed to RESIDENTIAL buyers and sellers. If you wish to engage a real estate professional under a different brokerage relationship you need to affirmatively discuss this matter with any agent you would like to employ. In my business, I do not accept Single Agent status without an Exclusive Buyer Broker Agreement or an Exclusive Right to Sell Agreement, which is contingent upon certain criteria being met by the potential client, including full disclosure. It is not likely that I will consent to a Single Agency Brokerage Relationship unless I am being employed by an entity which requires fiduciary services in Florida. In that instance, a Scope of Services Agreement will need to be executed by the potential Client before any fiduciary level services are provided.

FLORIDA LAW REQUIRES THAT REAL ESTATE LICENSEES WHO HAVE NO BROKERAGE RELATIONSHIP WITH A POTENTIAL SELLER OR BUYER DISCLOSE THEIR DUTIES TO SELLERS AND BUYERS.

As a real estate licensee who has no brokerage relationship with you, Karen Lee Bertiger, Licensed Real Estate Broker,  owes to you the following duties:

                       1.  Dealing honestly and fairly;

                             2.  Disclosing all known facts that materially affect the value of residential real property
                                  which are not readily observable to the buyer.

                             3.  Accounting for all funds entrusted to the licensee.

A written scope of services agreement is also required by this firm in addition to any other disclosures and notices required by law as we do not accept ANY funds or perform any services for ANYONE without a written scope of services agreement in advance of provision of any services. This also protects our prospects, customers and clients.
